Like all other states, Maryland has a statute of limitations, or a time limit on how long you have to file a medical malpractice claim. Once the statute of limitations expires, your claim may be barred forever.
Under Maryland law, parents have three years from the date they knew or should have known about the injury. Parents have no more than five years since the injury occurred to file a claim. In the case of minor plaintiffs, this time limit may extend up to 21 years. In cases of infant wrongful death, you have three years from the date of death to file a claim.
