How Long Do I Have to File an Illinois Birth Injury Lawsuit?

When you file a birth injury claim in Chicago, Cook County or in the state of Illinois, you actually file a medical malpractice claim. Under Illinois law, you have two years from the date you knew or should have known about the injury to file your claim, and no more than four years since the injury occurred. However, in the case of minors, this time limit may extend up to eight years.
