Electronic Medical Records Requests and How They Can Affect Your Case

When pursuing a claim for your baby’s injury, you want to get help right away. But one of the things that can slow down that process is gathering your medical records from your provider. Providers often produce your medical records faster when you make the request as opposed to your attorney, and usually for a lesser fee. Speeding up the process in obtaining access to your records can have a big impact on your case, especially if statutes of limitations are at issue.

The process begins with a letter requesting a copy of your Protected Health Information from your provider. Request your prenatal chart from your doctor’s office (under the mother’s name) as well as reports for the mother and baby from the hospital. Lastly, request to obtain the fetal monitoring strips. Most importantly, don’t take “no” for an answer—you have a right to obtain your records.
